ISLAMIC LAW ON DIVORCE (SURAH AT-TALAQ, VERSE- 2)


Assalam oalaikum,

 In verse 65:2 of the Holy Quran, Allah (swt) says,
“The when they are about to fulfill their appointed term, either take them back in a good manner or part with them in a good manner. And take for witnesses two just persons from amongst you (Muslims). And establish the witness for Allah. That will be an admonition given to him who believes in Allah and the Last Day. And whosoever fears Allah and keeps his duty to him, He will make a way for him to get out (of every difficulty)

The waiting period or Iddat for a woman (after divorce) is of three menstrual periods. If a man wishes to reunite with his wife (after pronouncing divorce for one or two times) then he is expected to reconcile with her within this waiting period. Otherwise the man should leave his wife, honorably.
Whether a man reconciles with his wife or gives her an irrevocable divorce, in both the cases he should bring forth two just men from amongst the Muslims, as witnesses. In this verse Allah (swt) instructs the witnesses to bear testimony for His sake. The witnesses should be impartial towards both the parties involved. The importance of having witnesses is obvious as their presence can prevent any confusion or complication later on.
In the hadith mentioned below the importance of having two witnesses (during divorce and reunion) has been stressed.
Hazrat Imran bin Hussain was asked, ‘A man divorced his wife and later on he took her back. But he did not call anybody to witness pronouncement of the divorce nor resumption of the relation’. He replied, ‘You pronounced the divorce against the Sunnah and you took your wife back against the Sunnah. You should call men to witness both at divorce and at resumption of relation, and you should not commit this mistake again.’ (Abu Dawwod)
